The application, the software, the website (emosciens.com) have been developed and are operated by EmoScienS Inc, a company incorporated under the Business Corporations Act of Quebec (« EmoScienS ») Where (« we ») in order to provide information services (« Services ») for people over 14 years of age in Quebec and Canada to help them take care of their emotional health (« user » Where « you »).

The use of the services of EmoScienS is subject to the present conditions of use, hereinafter the « Terms of use », to our Privacy policy and our Cookies Policy which form an integral part of these Terms of Use.

By creating a user account or using the EmoScienS Services, you acknowledge that you are a user over the age of 14 and that you have read, understood and accepted the terms of these Terms of Use without any reservations.

In the event that you do not fully accept the terms of these Terms of Use or if you do not have the power or capacity to consent to them, we ask that you refrain from creating a user account or using EmoSciens.

EmoScienS uses third-party technology services to provide certain features, notably the automated analysis of facial expressions. Since 2024, this functionality has been made possible through the integration of the Hume AI platform, an external company specializing in emotion recognition powered by artificial intelligence. Portrait photos submitted for emotional analysis are temporarily processed by Hume AI’s servers to generate the metrics displayed on the user’s dashboard. According to Hume AI’s public documentation, these images are processed only for the time necessary to extract the relevant information. However, EmoScienS has no direct control over the processing carried out by Hume AI or over its internal data retention or usage policies.

Therefore, EmoScienS cannot guarantee or be held responsible for the compliance of Hume AI’s processing with all Quebec or Canadian privacy laws. Users are encouraged to consult Hume AI’s terms of use and privacy policy (https://www.hume.ai/terms-of-use and https://www.hume.ai/privacy-policy) before using our services involving facial recognition. By accepting these terms, you expressly consent to certain facial images you voluntarily choose to submit being temporarily processed by Hume AI. If you are not comfortable with this condition, we recommend that you do not use the facial expression recognition features in the EmoScienS application.

Although EmoScienS implements security practices considered to meet industry standards to protect personal data, no technology is entirely immune to risks of unauthorized access or misuse—particularly when third-party services are involved. The use of external technologies such as Hume AI may result in your data being processed outside of Canada, notably in the United States, where privacy laws may differ. EmoScienS cannot be held responsible for the processing or security practices of these third parties, nor for any resulting consequences, despite selecting partners that publicly demonstrate a commitment to data protection. By continuing to use the advanced features of the EmoScienS application, the user acknowledges and accepts this risk.

1.1 To access the EmoScienS Services, you will need to use an email, define a password, document your first and last names, and certify that you are over 14 years old.

1.2 You are responsible for all activity resulting from the use of your login credentials to access the EmoScienS Services.

1.3 Your account is personal to you, and you may not share your login information with any third party or allow them access to your account.

​1.4 As you will be responsible for all activities that occur under your access authorization, you agree to prevent any unauthorized access or use of the platform, except in cases of force majeure (for example, theft of your authorization ). Please let us know as soon as possible if something has happened. If you share your access credentials, we reserve the right to close the account without notice for security reasons.

The costs of using your device that are charged by your Internet or telephony provider will apply according to the use you make of it (in particular with respect to data consumption).

Our Property Rights. You acknowledge that EmoScienS inc. owns all copyrights and intellectual property relating to the technologies and information underlying the EmoScienS services and understand that:

4.1. The technologies and information underlying the EmoScienS Services belong to us;

4.2. you may not make a reference to EmoScienS or the EmoScienS Services, or include a link to the data repositories where the EmoScienS application can be downloaded, without express consent from us;

4.3. you will retain any “©” markings or other copyright (or other intellectual property) symbols as referred by EmoScienS if you decide to copy information or any computer code belonging to EmoScienS; and;

4.4. you will not use our trademarks, logos, other symbols, names and any other intellectual property rights without first obtaining our written permission.

4.5. Comnication. You will notify EmoScienS without delay by sending an e-mail to info@emosciens.com any unauthorized use of the EmoScienS Services that would be brought to your attention.

5.1. Warning. EmoScienS and its Services do not provide clinical advice and do not recommend or endorse any specific test, product, procedure, opinion or other clinical information. EmoScienS Services are provided for educational and informational purposes ONLY. To leave no doubt, the EmoScienS Services were not created to meet the specific needs of certain users or to provide a list of all the means available to watch over their emotional health.

5.2. Your Responsibility. You accept full responsibility for your user account and the use you make of the EmoScienS Services. Under no circumstances can EmoScienS be held responsible for malicious use of our Services. It is your responsibility not to share your user account credentials. We have no obligation to control, monitor or modify your user account.

5.3. Limitation of Liability. In no event, including but not limited to negligence, errors, omissions, shall we or our third party licensors, if any, be liable for any direct, indirect, special, incidental, or consequential damages , including, but not limited to, loss of data or profit, arising out of the use of, or inability to use, the EmoScienS Services, even if we or one of our authorized representatives has been informed of the possibility of such damages.

5.3.1. This expressly includes services and processing provided by external technology partners, notably Hume AI, which offers certain emotional analyses based on your portrait photos. EmoScienS does not control the algorithms, methods, or IT infrastructure of these partners and cannot be held responsible for their practices, technical decisions, or security incidents.

5.3.2.The user acknowledges that it is their responsibility to read, understand, and accept the terms of use and privacy policies of these third-party services before submitting any data as part of the related features. By continuing to use the functions associated with emotional analysis, the user accepts the risks involved in using such third-party services, including those related to data retention, location, or security.

5.4. No Warranty. Even if we use technologies deemed safe within the framework of the EmoScienS Services – like any technology – they are not infallible or immune to unforeseeable events. Information provided as part of the EmoScienS Services may contain technical inaccuracies or typographical errors. Information may be changed or updated without notice. We may also make improvements and/or changes to the products and/or services described in this information at any time without notice. Subject to applicable laws, we make no representations or warranties with respect to (a) the use and fitness for a particular purpose of the EmoScienS Services; (b) their uninterrupted, continuous and bug-free use; (c) their availability at all times and without delay; (d) their compliance, other than with the criteria provided for in these Terms of Use; and (e) intellectual property rights in connection therewith.

5.5. Theft or compromise of any type of information. Although our technologies adhere to industry standards to maintain the security and privacy of user information, we cannot guarantee that there is no risk of user information being stolen or compromised. We are not responsible for situations in which a user’s personal information or information may be stolen or compromised due to a cyber-attack or negligent user behavior.​

6.1. Start. These Terms of Use will apply as soon as you have created a user account or use the EmoScienS Services.

6.2. End. You can stop accessing or using the EmoScienS Services at any time and without any action on your part. You can also remove the EmoScienS application from your device. You can request the deletion of your personal information by contacting EmoScienS via the means of communication mentioned in section 8.4. We may also terminate the EmoScienS Services. This will be done in accordance with applicable laws.

6.3. Right to suspend certain accesses. Rather than terminating EmoScienS and its content, we could limit, restrict or suspend the use of the EmoScienS Services, the time to resolve a situation (eg, a defect, a bug or a virus).

To access EmoScienS, you will need to use an email, define a password, document your first and last names, and certify that you are over 14 years old. No other disclosure of personal information is required to use EmoScienS or its content. Furthermore, we do not advertise on EmoScienS. Finally, we do not collect personal information other than your email to contact you. Additionally, please note that we process your personal information in accordance with applicable laws and our Privacy Policy and Cookies Policy. Finally, EmoScienS implements commercially appropriate security procedures to help protect your personal information. If a security breach relating to your personal information should occur, we will use commercially reasonable efforts to comply with all applicable laws regarding the management and notification of security breaches of users’ personal information. We will notify you of such an incident if it poses a risk of “serious harm” to you, as required by law.

EmoScienS and its content includes links to other help resources. These hyperlinks are provided for informational purposes, among other things, to facilitate your access to more support in terms of emotional health monitoring. However, we remind you that:

• these resources are not controlled by us;
• we do not systematically validate their content; and
• we cannot guarantee their content.

These resources are subject to their own terms of use and privacy policies. We therefore assume no liability in connection with them. The decision to consult these hyperlinks rests with you.

9.1. Complete agreement. These Terms of Use constitute, with the Privacy Policy, all the rules applicable to your use of EmoScienS and its content.

9.2. Amendment. Please note that we reserve the right to modify these Terms of Use and our Privacy Policy at any time. Such changes will then be brought to your attention by written notice on our website prior to such changes becoming effective. These changes cannot have a retroactive effect on the aforementioned documents. By continuing to use EmoScienS following modifications that have been publicly revealed or brought to your attention, you are deemed to have fully accepted them; if you do not accept these changes, you must close your user account by ceasing to use the EmoScienS Services and/or the EmoScienS application on your device at the time these changes take effect.

9.3. Governing Law and Competent Jurisdiction. These Terms of Use shall be interpreted in accordance with the laws of the province of Quebec and the laws of Canada applicable in that province. This Agreement shall be deemed in all respects to be a distance or off-premises contract governed by the laws of the Province of Quebec, without regard to principles of conflict of laws.

You irrevocably agree, unless required by law, that any dispute arising from these Terms of Use shall be submitted to a competent court in the judicial district of Montreal, province of Quebec.

9.4. French and English language. If a problem of definition or interpretation arises between the English and French versions of this agreement, the French version prevails.
